Attorneys Eric Ginnis and Ross Zelnick of Ginnis, Krathen, & Zelnick P.A. along with appellate counsel Neil Rose, were victorious in a 3-year court battle to establish liability against a Massage Envy franchise for an incident involving the improper pregnancy massage of a 16-week pregnant young lady.
The young woman went to a Massage Envy franchise for a scheduled prenatal massage. Due to the facility’s negligence, there was not sufficient oversight to ensure that the massage was safe for pregnancy, and the woman did not receive a prenatal massage.
Due to the incorrect massage that was administered and the failure of the staff to stabilize her following the improper massage, the young woman fainted while still at the facility. As a result of her fall, she suffered catastrophic injuries to her jaw.
Following a week-long jury trial in Broward County and almost 3 hours of deliberations by the Jury, the Massage Envy franchise was found to be 100% at fault.
