CASE FACTS

  • Plaintiff Luis Santana, 62, was driving in Dania Beach when he encountered two vehicles that had collided and were stopped on the Interstate 95 roadway. Santana veered left to avoid the vehicles, but his SUV struck the roadway’s median barrier, stopped perpendicular to the flow of northbound traffic, and was then struck by a car driven by Enrique Jose Bermudez.
  • With the support of counsel at Ginnis, Krathen, & Zelnick, Santana sued a variety of parties including Bermudez, Oscar Ramirez (one of the motorists involved in the accident’s first collision), NZ Enterprises LLC (the owner of Ramirez’s vehicle), and Ramirez’s employer, Beerstream LLC.
  • The lawsuit alleged that Bermudez and Ramirez were negligent in the operation of their vehicles, that N Enterprises was vicariously liable for Ramirez’s actions, and that Beerstream was liable because the accident occurred while Ramirez was on duty.
  • Santana’s counsel at Ginnis, Krathen, & Zelnick negotiated pretrial settlements of the claims against Bermudez and NZ Enterprises, while the trial addressed damages against Beerstream and Ramirez.
